Prohibited Conduct
- *Academic dishonesty, including but not limited to, cheating, plagiarism, misrepresentation of student status, and resume falsification. Plagiarism includes, but is not limited to, the use by paraphrase or direct quotation, the published or unpublished work of another person without full and clear acknowledgment; unacknowledged use of materials prepared by another person or agency engaged in selling or otherwise providing term papers or other academic materials; and commercialization sale or distribution of class notes without the instructors' permission.
- Intentionally or recklessly interfering with normal university or university sponsored activities including, but not limited to, teaching, research, university administration, fire, police or other emergency services, ceremonial events, scheduled interviews, co-curricular activities or other functions on university premises or officially arranged university activities off campus.
- *Intentionally, recklessly or negligently causing physical harm to any person on university premises or at university sponsored activities. This includes engaging in any form of fighting.
- Intentionally, recklessly or negligently placing any person under mental duress or causing any person to be in fear of physical danger through verbal abuse, harassment (including repeated phone calls), sexual harassment, hazing, intimidation, threats or other conduct which threatens or endangers that person's emotional, mental or physical well-being.
- *Criminal sexual behavior, including but not limited to, the implied, use or threatened use of force to engage in any sexual activity against a person's will and/or engaging in such behavior with a person who is unconscious, substantially mentally impaired (including intoxicated); intentionally touching another person's genitals, buttocks or breasts without the person's consent; indecent exposure; voyeurism.
- *Use or possession of weapons on university premises, unless expressly authorized by the university. "Weapon" is broadly defined to include, but is not limited to, all firearms (including BB guns), dangerous knives, explosives, explosive fuels, dangerous chemicals, billy clubs, fireworks, and inappropriate use of vehicles.
- *Intentionally or recklessly activating a fire alarm without cause; damaging fire safety equipment or initiating a false report, warning or threat of fire, explosion or other emergency on university premises.
- *The use, possession or distribution of any controlled substance or drugs and/or drug paraphernalia on university premises.
- *Use, possession or distribution of alcohol on university premises except as expressly permitted by university policy. Sale or provision of alcohol and/or controlled substances to underage students off-campus (e.g. hosting a house party). Students who violate this provision will be subject to suspension or expulsion from the university in addition to possible criminal charges.
- Knowingly furnishing false information to university personnel; or the knowledgeable passing of an insufficient funds check or fraudulent money order in payment of any financial obligation to the university.
- Forgery, unauthorized alteration or unauthorized use of any university document or instrument of identification. Students who commit permit fraud, including, but not limited to, any altering of a valid parking permit, displaying the permit of another, or creating and/or displaying a false permit, will lose all on campus parking privileges for the remainder of the current semester and at least one subsequent semester in addition to other possible university sanctions.
- *Theft, attempted theft, unauthorized borrowing or use of any university property or service wherever located, or the theft, attempted theft, or unauthorized borrowing or use of public or private property on university premises.
- Unauthorized presence in, or use of university premises, facilities or property this includes, but is not limited to, unauthorized presence in another student's residence hall room or any university building.
- Rollerblading, rollerskating and skateboarding in all university buildings including the residence halls.
- Inappropriate use of laser pointers outside of an academic setting is prohibited. The use of laser pointers in any classroom, auditorium or at any university sponsored function without the explicit permission of the faculty/speaker is prohibited.
- *Unauthorized or fraudulent use of the university facilities, telephone system, mail system, or computer system or use of any of the above for any illegal act or any act prohibited by the Code of Conduct.
- Deliberate destruction of, damage to, malicious use of, or abuse of any university property, wherever located, or the deliberate destruction of, damage to or malicious use of public or private property on university premises.
- Failure to comply with the directions of university officials including, but not limited to, university public safety, residence hall staff, faculty or administrators acting in the performance of their duties; failure to present identification upon request to university personnel in the performance of their duties.
- Gambling for money or other things of value on campus or at university sponsored activities except as permitted by law.
- Falsely claiming to represent the university or a student organization of the university.
- *Actions which unreasonably interfere, obstruct or prevent the regular and essential operations of the university or infringe upon the rights of others to freely participate in its programs and services. This may include, but is not limited to, intentionally and substantially interfering with the freedom of expression of others; participating in a campus demonstration which disrupts the normal operations of the university; occupying a campus building after regular office hours; intentionally obstructing or interfering with the freedom of pedestrian or vehicular movement on campus.
- Violation of published university policies, rules or regulations including, but not limited to, computer use, parking, smoking, solicitation, distribution of literature, sexual harassment, residence hall agreement, and amplification and loud speaker use, which can be found elsewhere in the student handbook (online) or separate university policies.
- *Parties and/or large gatherings which disturb the peace of campus residences or off-campus neighborhoods.
- *Apparent or alleged violation of local ordinances, federal or state law on university premises or at university sponsored or supervised activities, where said violation poses a substantial threat to the safety and/ or welfare of campus community members.
- *Interfering with the judicial procedures or outcomes, including but not limited to, falsification, distortion or misrepresentation of information before a hearing officer or judicial panel; knowingly initiating a complaint without cause; harassment and/or intimidation of any member of the judicial board, witness, or university personnel before, during or after a proceeding; failure to comply with the sanction(s) imposed by either a hearing officer or judicial panel.
- Any student removed from a residence hall for disciplinary reasons will have his/her file reviewed by the Associate Vice President for Student Life to determine if further university disciplinary action is necessary.
- Additional sanctions may occur pending hearing with the Associate Vice President.
- Attempts and complicity: attempts to commit acts prohibited by this code, or encouraging others to commit acts prohibited by this code will be punished to the same extent as if one had committed the prohibited act.
- Student violators will be held financially responsible for direct and/or indirect charges associated with Code of Conduct violations.
- Students are responsible for updating directory information (including address) with the Office of Records and Registration.
- Failure to pay and attend a chemical use assessment, alcohol education class or drug education class may result in additional university sanctions.
*Prohibited conduct noted with an asterisk generally will be referred to the judicial panel for resolution unless the accused specifically requests a hearing with the Associate Vice President for Student Life and Development and when final examinations, breaks or other vacation periods would prevent a timely hearing by the judicial panel; or when, in the judgement of the Associate Vice President for Student Life and Development, appearing before the judicial panel poses a threat to the physical welfare of panel members or witness(es).
