Faculty Asynchronous Package Agreement Terms

The following terms apply to the Asynchronous Learning Package Agreement (PDF). By signing the attached Agreement, you agree that you have read the following terms:

  1. Intellectual Property Rights and Course Ownership

    As dictated by the MnSCU Intellectual Property Rights Board Policy 3.26, i ntellectual property rights in scholarly works belong to the faculty member, student, or professional staff who created the work. Scholarly works are creations that reflect research, creativity, and/or academic effort. Scholarly works include course syllabi, instructional materials (such as textbooks and course materials), distance learning works, etc. Faculty shall retain intellectual property rights for their print and online self-paced or other packaged courses. http://www.mnscu.edu/board/policy/326.html
  2. Faculty Compensation

    Pursuant to the current IFO contract, Article 10, Section A, Subd. 6, faculty members providing packaged courses approved by the President/designee shall be compensated at the rate of sixty-five dollars ($65) per credit hour per student. Graduate courses will be weighted as follows: a three (3) credit graduate course shall be the equivalent of a four (4) credit undergraduate course, and a four (4) credit graduate course shall be the equivalent of a five (5) credit undergraduate course. All other graduate courses shall be calculated as the equivalent of one and one fourth (1.25) undergraduate credits per one (1) graduate credit hour. Graduate equivalency shall apply only to courses exclusively for graduate students.
  3. Course Licensing Agreement

    Compensation for self-paced or packaged course development shall constitute a course licensing agreement between the faculty developer and St. Cloud State University, Center for Continuing Studies (CCS). Faculty agree to: (1) offer the course during the school term (Fall and Spring) and optionally in the Summer term. (2) Notify the CCS at least one year prior to beginning their retirement or sabbatical. Faculty approved for phased retirement should notify CCS of their course load/credit limitations to ensure compensation and FTE limits are in compliance with MnSCU policy. Faculty are unable to teach online or self paced courses during sabbatical.

    If a faculty member chooses to discontinue their online/self paced course for any reason, a replacement instructor may be authorized by the academic department and will require a new package agreement. Any changes in faculty status will also require a new package agreement approved by the department.

    CCS reserves the right to cancel or discontinue an online or self paced course at any time.

Course Revision Policy

The purpose of course revision is to maintain the integrity and quality of packaged courses. CCS reserves the right to request revisions of print based and online asynchronous courses every three (3) years to ensure course rigor, quality, and that technology standards are current with university requirements. A new Asynchronous Package Agreement will be signed at the time of revision.

Faculty may make changes at any time they deem necessary, although such changes will not affect students enrolled before such changes are instituted.

Copyright and Fair Use Permission

Fair use is a legal principle that defines the limitations on the exclusive rights of copyright holders. These guidelines apply to the use, without permission, of portions of lawfully acquired copyrighted works in educational multimedia projects which are created by educators or students as part of a systematic learning activity by nonprofit educational institutions. Educational multimedia projects which incorporate portions of copyrighted works under these guidelines may be used only for educational purposes. See attached Fair Use Guidelines for specific partial use allowances.

Books, chapters, articles, etc. used in full as part of course resource materials MUST carry lawful copyright permission by the author or publisher. For more information on obtaining lawful copyright permission, contact Susan Motin in Learning Resources & Technology Services at 255-4996. Continuing Studies reserves the right to refuse materials if proper permissions have not been obtained.

Utilization of Revenue

Revenue generated from the packaged courses is used to supplement additional course offerings, course development, and program administration.
