Civil Arbitration Training

Civil Arbitration Training

Date: May 21, 2010

Prerequisite: None

Overview

Arbitration, nicknamed the “businessman’s method of resolving disputes,” is governed by state and federal law.  Most states have provisions in their civil practice rules for arbitration. These provide a basic template for the arbitration as well as procedures for confirmation of an arbitrator’s award (the document that gives and explains the decision of an arbitrator), a procedure that gives an award the force and effect of a judgment after a court trial.  Many states have adopted the Uniform Arbitration Act, although some states have specific and individual rules for arbitration.  This course presents the necessary components involved in civil arbitration under Minnesota Rule 114.09 and includes a hands-on role play and other interactive work on the arbitration process.

Workshop Details

Trainers:

Madge Thorsen, Attorney At Law, Rick Kaplan, Attorney At Law.  Both are mediators, arbitrators and business and commercial litigators.

Prerequisite: 30-Hour Basic Mediation Skills Training

Times: Monday-Wednesday 8:00 a.m. to 4:30 p.m.

*CLE and Rule 114 Credit will be sought.

Overview

The transformative model of mediation is an alternative model from the interest-based or facilitative model of mediation. The philosophy of transformative mediation is very different from interest-based mediation. In transformative mediation:

  • The parties drive the process.
  • Conflict is viewed as an opportunity for learning and increasing understanding.
  • Conflict is not controlled by ground rules or separating the parties.
  • The mediators in transformative mediation guide the parties individually to a proactive state where they are empowered to voice their concerns and interests.

This model was created in the 1990’s and is used by various agencies such as the U.S. Postal Service.

Lisa Radzak, Attorney At Law
